"How Will I Cope With Lost Wages After an Accident?" Contact an Attorney for Answers
After an accidental injury, you may not worry about medical bills (yet), believing they will be covered by your own health insurance, your automobile insurance or another driver's auto insurance. You may not worry about taking time off work, because you believe you have sick leave and vacation time available.
But what will happen after you have used up all your sick leave and vacation time, and are still not ready to return to work — or if you are self-employed and have no paid time off? If you have a broken hip, you may not be able to return to work for at least three months — and perhaps up to a year. If you have suffered a brain injury, a spinal cord injury, or a back or neck injury, it may be a long time before you can work again — assuming you are able to return to work.
The question of what happens with lost wages is an example of the kind of question that we regularly — and gladly — answer for injury victims at the Boston law offices of Dane Shulman Associates, LLC. Whether you retain us or not, we consider it worth our while to listen to you and provide preliminary recommendations. Initial consultations are free.
In Massachusetts, a rule of thumb with Personal Injury Protection (PIP) is this: Massachusetts PIP protection has $8000 available to pay medical bills and up to 75% of your lost wages. The additional 25% of lost wages plus any medical expenses not covered by PIP can also be included in the bodily injury claim against a negligent driver who caused the accident. If you used sick leave provided by your employer, your PIP insurance will "buy back" those days that you used up to a certain amount, reimbursing your employer and restoring your sick leave to "unused" status. (This will enable you to use those sick days to prolong your time off work, if necessary.)
