Hit-and-run driver seriously injures Boston pedestrian

Halloween in recent years has become an excuse for adults to dress up in costumes and hit the town. Zombie pub crawls are also popular events. This past Halloween the owner of an Allston tattoo shop was struck by an SUV and suffered serious injuries. The SUV driver did not stop.

When a motorist strikes a pedestrian in a crosswalk, it is highly probably that the motorist could be found negligent and liable for the personal injuries suffered by the pedestrian. The injured person is within their rights to sue for compensation for their injuries, potentially including pain and suffering. That litigation becomes more difficult if the motorist is a hit-and-run driver.

According to news sources, on Halloween at about 4:00 in the afternoon a woman was about to cross a street at Commonwealth Avenue at Kelton Street when she realized the light had not yet changed. She was in the process of stepping back onto the center island when she was struck by a white SUV. The impact threw her up onto the windshield and she landed about 15 feet away.

The woman was taken to the hospital where she underwent several hours of surgery. She reportedly suffered pelvic bone broken in three spots, broken leg and gash on her forehead. None of the injuries were described as being life-threatening.

The SUV probably has a damaged windshield and so the owner of the car, if not the driver, may be located. The woman and her friends are hoping that the driver will turn come forward. Leaving the scene of an accident is a crime, so the driver could be facing criminal charges as well as civil litigation.
