Malfunctioning vehicle could result in wrongful death lawsuit

There are many potential causes of a workplace accident in Massachusetts. In many cases, employers and workers can identify potential risks and take reasonable actions to mitigate them in order to protect employees. Unfortunately, there may be little to no warning when a large piece of machinery malfunctions, causing a serious accident. A recent out-of-state accident involving such an incident could potentially result in a wrongful death lawsuit.

Police say that the accident happened in late February. The 36-year-old male victim was reportedly working at a machine shop that repairs industrial tanks. Unfortunately, the man was repairing such a tank when the vehicle's hydraulic functions reportedly malfunctioned. As a result, he was pinned between the tank and the bed of the truck.

Unfortunately, the worker died as a result of the injuries he suffered in the accident. An autopsy claims that his death resulted from asphyxiation caused by a crush injury. The incident is under investigation by both the coroner's office and the Occupational Safety and Health Administration.

After an accident such as this, it is important to determine the cause in order to prevent others from suffering similarly and to provide answers for grieving family members. Unfortunately, these family members may struggle emotionally and financially as a result of their loss.
