1 injured, 1 jailed after pedestrian accident in Massachusetts

Holidays often take a toll on law enforcement officials and other first responders. This year, Halloween was no different for the authorities in Massachusetts. They were called out on Halloween evening to the scene of a serious pedestrian accident.

According to reports, a 27-year-old man struck a 38-year-old pedestrian with his car. When the authorities arrived on the scene, they found the victim to be suffering from severe injuries as a result of the accident. He was transported by ambulance to a helicopter and was then flown to a nearby medical center for treatment.

The driver who allegedly struck the pedestrian was also found at the scene of the accident and subsequently arrested. Police have charged him with operating a vehicle while under the influence of drugs, speeding and with failure to keep to the right of the roadway. He was issued a $5,000 bail, but, since he allegedly violated an earlier probation, he remains in police custody.

Regardless of the outcome of the driver’s court case, he may still face the victim or his family in a Massachusetts civil court, as the pedestrian accident victim is reported to have been hospitalized with life-threatening injuries, including a brain injury. If the victim survives his injuries, he may choose to pursue personal injury compensation. If he succumbs to his injuries, his family members may file a wrongful death claim against the driver. In either case, if it is proven that the driver’s negligent actions led to the victim’s injuries, the victim or his family may be awarded damages for the accident-related losses.
