Lawsuit claims nursing home negligence, seeks damages

Adult children are often put in the stressful situation of having to make medical decisions for their ailing parents. In many cases, people in Massachusetts trust that a nursing home facility will provide proper care. Unfortunately, one out-of-state woman believes that nursing home negligence actually caused her mother’s condition to worsen.

In a recently filed lawsuit, the woman claims that her mother was placed in the care of Nexion Health in March 2012. Her mother had reportedly suffered a stroke and heart attack. While she had some mobility in her right side, her daughter maintains that paralysis on her mother’s left side meant that she needed at least two people helping her. Unfortunately, the lawsuit alleges that a nursing assistant attempted to move the woman from her bed to a wheelchair using a lift without waiting for additional assistance. The plaintiff claims that the assistant failed to properly secure a safety strap which caused her mother to fall while in midair.

After the fall, her mother complained of neck and head pain. She reportedly began to fear the nursing staff, and her condition worsened. The case filed against Nexion makes several allegations in addition to those related to the fall, including failure to properly care for known existing conditions, diagnose pneumonia and reposition the woman every two hours.

The decision to place a loved one in a nursing home is often a difficult one to make for people in Massachusetts, but it is often the best option in many situations. Unfortunately, nursing home negligence can often have devastating physical and mental consequences on patients and their families. Often by seeking legal recourse as this woman has done, families can hold medical care professionals responsible for their actions and possibly protect others from such suffering.
