Wrongful death lawsuit possible option in Massachusetts crash

Police said the driver of the sport utility vehicle never did stop for the bicyclist. Authorities have noted that the vehicle was light-colored and should have damage to its front. Police continued to investigate the fatal crash.

The family members of the deceased bicyclist can rightfully file a wrongful death lawsuit in this scenario if the vehicle driver is captured. This driver may face criminal charges related to an alleged hit-and-run accident. However, a wrongful death suit can also be brought against a driver who is believed to be liable. Acts, including driving while distracted or disobeying any other rule of the road, could be considered negligent or reckless behavior depending on the situation, and, if this type of behavior can be established, the driver could very well be held liable.
