At this time of the year, families in Massachusetts are enjoying the time with their family. Unfortunately, one family is now mourning the loss of their loved one after he was hit by a car while crossing the road. He later died. The driver of the car has since been charged with drugged driving.

The accident happened one evening in mid-December. Reports indicate that the 71-year-old victim parked his car across the street from the Christmas tree lot he owned. As he crossed the street, he was allegedly struck by a car driven by a 33-year-old man.

Because of the serious nature of the injuries he suffered in the accident, he was airlifted to the hospital. Unfortunately, he later passed away. The driver of the car is said to have stayed at the scene. A drug recognition expert examined the man and reportedly determined that he was on drugs. Although the man has been charged with drugged driving, some officials anticipate that there will be additional charges added due to the serious nature of the incident.

Unfortunately, many people who are hit by a car are unable to recover from their injuries. Many of these incidents occur through no fault of the victim. In these fatal incidents, the surviving family members have the option of suing the party or parties believed responsible in a Massachusetts civil court. If negligence can be proved, the court could order that a defendant pay monetary damages stemming from an accident. These losses can include funeral expenses, medical bills and lost wages, among others.
