Pedestrian accident leaves Massachusetts family without loved one

Crosswalks were designed to give pedestrians safe places where they could cross roads. When in a crosswalk in Massachusetts, pedestrians generally have the right-of-way. In order to avoid a pedestrian accident, drivers are supposed to stop and allow pedestrians to safely cross.

In mid-October, a 65-year-old man became the latest pedestrian victim who was struck while attempting to cross the road at a crosswalk. Apparently the gentleman and another man had just gotten off a bus and were crossing in the crosswalk. Both men were struck when a driver failed to stop for them. The 65-year-old man was killed, and the other man sustained bodily injuries. Both men were transported to a local hospital.

Reports indicate that the accident occurred shortly before 7 a.m.; therefore, it was still somewhat dark outside. Additionally, it had been raining, and the roads were wet. However, there were posted yellow signs indicating the crosswalk ahead. While it would have been beneficial for the men to look both ways and make sure that there was no approaching traffic, they were in a crosswalk where they had the right-of-way.

At this time, no charges have been filed against the driver, and the matter is still under investigation. A pedestrian accident can be devastating to a family. In addition to the emotional loss experienced, there will also most likely be financial losses as well. Even if traffic and/or criminal charges are not filed, it is possible that the victims’ families may decide to pursue the matter in a Massachusetts civil court.
