Massachusetts biker victim of fatal car accident

One person is dead and another seriously injured following a crash involving a motorcycle in West Bridgewater. Massachusetts police are in the process of conducting an investigation into the fatal car accident. For the moment, they have not filed charges against anyone involved.

The accident report is not complete at this time, but it has been so far confirmed that the crash occurred around 8:40 p.m. the night of May 28 on Route 24. Apparently, a 46-year-old man was operating a motorcycle headed southbound on the route, when his vehicle struck a car. The force of the impact caused serious injury to the man and his 53-year-old female passenger.

Both individuals were rushed to local hospitals. The man was later pronounced dead, while the woman remains in critical condition as of this report. The status of the driver of the car and any passengers in that vehicle is unknown at this time. Police were still focused on documenting the specifics of the crash.

In a fatal car accident where one driver involved is killed, criminal charges are not always guaranteed, as they are not filed posthumously. However, if the evidence suggests that fault lies with one or both drivers, the seriously injured woman would have grounds to pursue a personal injury claim. These types of lawsuits are heard in a Massachusetts civil court, and require proof of negligence that is found to have caused or substantially contributed to the accident. Whether the estate of the deceased biker has grounds for a wrongful death claim will depend upon a full development of the facts.
