Dog Bite Awareness Week attempts to educate pet owners

On behalf of posted in Premises Liability on Wednesday May 27, 2015

Millions of households across the country have dogs that are counted as part of the family. The vast majority of dog owners would likely assert that their dog is perfectly harmless and would never attack another person, even a stranger. Unfortunately, millions of people in this country are injured by a dog bite every year, including many in Massachusetts. Despite what a dog owner might believe, when a dog is placed in an unfamiliar situation with strange people, its behavior may be difficult to predict. If a dog does attack, the owner could face claims for financial liability. The Center for Disease…

Massachusetts legal help following dog bite

On behalf of posted in Premises Liability on Thursday May 7, 2015

Many households in Massachusetts and across the country have pets that are considered part of the family. While a pet, such as a dog, may behave one way for its family, its behavior could be unpredictable around strangers. In some circumstances, dogs have been known to attack an innocent bystander, often with no provocation. Anyone who has been attacked by a dog likely knows of the damage that a dog bite can cause. Depending on the severity of the attack, the victim may require immediate or even long-term medical care. In some cases, plastic surgery may also be necessary. Unfortunately,…

On behalf of posted in car accidents on Wednesday April 22, 2015

People often make imprudent choices in their lives for a variety of different reasons, with a variety of different outcomes. These decisions could, unfortunately, harm many people. For example, people who choose to engage in street racing could potentially cause harm to themselves as well as other users of the roadways if their actions result in car accidents. Police in Massachusetts believe that three people were recently sent to the hospital as a result of street racing. The incident occurred just before 11 p.m. one night in mid-April. An ambulance returning from a call reportedly called in a report of two…

Wrongful death lawsuit could follow Massachusetts accident

On behalf of posted in wrongful death on Thursday February 19, 2015

Like most people, a young man in Massachusetts had plans for his life. He had a job -- his employer described him as a reliable employee -- that would help him save for his wedding. Unfortunately, his plans came to a tragic halt after a fatal car accident took his life while he was at work helping a stranded driver. The accident may be viewed as having resulted in a wrongful death. The accident happened around 3 p.m. one afternoon in early February. The 22-year-old two-truck driver was responding to a call made by a motorist with a flat tire. Because the motorist…

Women who are expecting have a million different things to worry about. They worry about how their baby is developing, how their food intake will impact the baby and if they will go into labor too early, among many other things. With all these things to be concerned about, auto accidents are probably low on the list. However, a pregnant woman was recently airlifted after a collision in Massachusetts. The accident happened late one afternoon in early February. Police say they discovered a pregnant woman who was trapped inside a sedan after a collision. Tractor-trailers serve a vital role in this country's economy by moving goods from place to place in a relatively efficient manner.  Many drivers are well-trained professionals who simply want to earn a living and preserve their own safety as well as the safety of those they may encounter on the roadways. Unfortunately, mistakes made by tractor-trailer drivers can result in serious highway accidents. For example, two people in Massachusetts suffered serious injuries in a collision with such a vehicle. The accident happened one night in late January. Police say that the 55-year-old driver of a tractor-trailer was attempting to turn left…

Getting the dreadful news that their child has been in a serious car crash is likely most parents' worst nightmare. Another suit against doctor with history of medical malpractice

On behalf of posted in Medical Malpractice on Saturday November 22, 2014

A doctor is currently facing a medical malpractice lawsuit for the 12th time since 1996. Massachusetts readers will note that the most recent suit is related to complications following a laparoscopic procedure. The current case is the second time the doctor has been accused of medical malpractice just this year. According to records, this doctor has paid recompense related to malpractice cases on four different occasions since 2009. Three other lawsuits are currently pending in the legal system, and it is possible that a fifth payout could happen. It is not immediately clear why the repeated medical malpractice cases have not raised "red flags" within the medical…

Proposed law has provisions that may prevent medical malpractice

On behalf of posted in Medical Malpractice on Thursday October 30, 2014

One state will be voting on proposed law and seems to be concerned with raising the cap on monetary awards for patients who have been harmed by their physicians. However, the bill also contains provisions that may help prevent some instances of medical malpractice altogether. While this battle is not being waged in Massachusetts, the language in the bill addresses problems that may apply to doctors everywhere. While the bill faces strong opposition from malpractice insurance providers (as well as large segments of the medical community), the legislation calls for drug and alcohol testing for doctors who have admitted problems with substance abuse. Doctors who are…

Parents wait to see if son’s death was from failure to diagnose

On behalf of posted in Medical Malpractice on Wednesday October 22, 2014

A family is grieving the loss of their teenage son after he died during a basketball game. Purportedly, he had received a sports physical, but it is unclear whether a serious condition was overlooked. While many Massachusetts residents may have been a victim of a doctor's failure to diagnose, it is tragic when a mistake leads to the death of a loved one. The parents may have to wait several months before the final report is completed on what caused their 17-year-old to collapse and die. He was given clearance to play after undergoing the health examination. However, a doctor who was interviewed described the examination as a screening rather than…
