In Boston, we understand that drivers are too often in a hurry and not always careful to look for pedestrians. Unfortunately, sometimes careless, hurried drivers will hit a pedestrian with the right of way. That might well be what happened in an out-of-state pedestrian accident in which a Houston, Texas, man was hit by a tractor-trailer. Multiple injuries in two-vehicle crash

Details are scarce about a two-vehicle crash far to the west of Suffolk County yesterday. A brief news report from Ashfield, Massachusetts, says several people were seriously injured in a two-vehicle collision there. Emergency crews from surrounding Franklin County towns responded to the Route 112 car accident early yesterday evening. Four ambulances were called to the scene where three people were trapped in a vehicle, according to the report. A State Police spokesperson said no one had died in the crash, but that there were "serious injuries." A 2006 Chevy Colorado pick-up truck and a 1995 Honda Accord collided near Sanderson Academy.…

Pedestrians should use a crosswalk, not the highway

Most people use a crosswalk when deciding to cross the street. In Massachusetts, the pedestrian in the crosswalk is supposed to have the right of way. This does not always mean that people use the crosswalk, nor does it mean that drivers adhere to this rule of driving. Over the holiday, an incident at a local Boston hospital reinforces the statistics and reasoning behind the rearview cameras discussed in the last blog. One life that was just lost could have potentially benefitted from such a requirement in vehicles, especially large ones with many blind spots. We have posted several blogs during the past year about pedestrian accidents. There were four in November, four posts in October and ten during the summer months. East Hampstead pedestrian seriously injured when struck by car

Central Street in East Hampstead is a two-lane road without much of a shoulder, although the shoulder is clearly marked. If a person was walking on the shoulder, and a car was driving within its lane, there is no reason why an accident should occur. The aerial view shows that the neighborhood is primarily residential. Quincy Avenue in Quincy, Massachusetts has two lanes going in either direction. There are sidewalks on either side of the road, but to cross the road there are widely spaced crosswalks at busy intersections. Halloween in recent years has become an excuse for adults to dress up in costumes and hit the town. Zombie pub crawls are also popular events. This past Halloween the owner of an Allston tattoo shop was struck by an SUV and suffered serious injuries. The SUV driver did not stop. According to a bird's-eye view from Google maps, the intersection of Wilbur Avenue and Harvard Street in Swansea, is a T intersection where Harvard Street dead ends at Wilbur. There are run down sidewalks, faded crosswalk markings on Harvard Street and a moderate shoulder for the two lane roads. It was at this intersection at about 7:29 in the evening when a pedestrian crossing Wilbur Street was struck by a car driven by a 58-year-old woman. Criminal charges filed for fatal pedestrian accident

When an accident occurs in Boston or elsewhere, it is entirely possible for there to be both criminal charges and civil litigation for the same incident. It is also possible to be found not guilty in one court and liable in the other court. The most famous case like this was O.J.
